CONSENT AND OPT-IN AGREEMENT

TCPA CONSENT AND SMS OPT-IN DISCLOSURE

This SMS and Marketing Consent Agreement (“Agreement”) governs your consent to receive text messages and marketing communications from NOVALAB HUMAN PERFORMANCE CLINIC LLC, doing business as Nova Lab Clinic (“Company,” “we,” “us,” or “our”).

1. CONSENT TO RECEIVE SMS/TEXT MESSAGES

By providing your mobile phone number and opting in, you expressly consent to receive the following types of text messages from Nova Lab Clinic:

1.1 Transactional Messages (Non-Marketing)

  • Appointment confirmations, reminders, and scheduling updates
  • Prescription and medication notifications
  • Laboratory result availability alerts
  • Account and billing notifications
  • Treatment protocol reminders
  • Telehealth appointment links and instructions
  • Important updates regarding your care

1.2 Promotional/Marketing Messages (Requires Separate Consent)

  • Information about new services, treatments, or offerings
  • Special promotions, discounts, or wellness programs
  • Health tips, educational content, and newsletters
  • Surveys and feedback requests
  • Event invitations and announcements

2. MESSAGE FREQUENCY AND COSTS

Message Frequency:

Message frequency varies depending on your treatment plan, appointments, and your marketing preferences. You may receive anywhere from 1-10 messages per month for transactional purposes and up to 4 marketing messages per month if you have opted in.

Message and Data Rates:

Standard message and data rates may apply based on your mobile carrier and service plan. Nova Lab Clinic is not responsible for any charges incurred from your mobile carrier for receiving text messages. Please consult your carrier if you have questions about your messaging rates.

3. OPT-IN REQUIREMENTS

Your consent to receive text messages must be provided voluntarily. By checking the opt-in box or otherwise indicating consent, you confirm that:

  1. You are the owner or authorized user of the mobile phone number provided.
  2. You are at least 18 years of age.
  3. You consent to receive automated and non-automated text messages at the number provided.
  4. Your consent is not a condition of purchasing any goods or services from Nova Lab Clinic.
  5. You understand that message and data rates may apply.

4. HOW TO OPT OUT

You may revoke your consent and opt out of receiving text messages at any time using any of the following methods:

Reply STOP:

Text “STOP” to any message you receive from us. You will receive a one-time confirmation that you have been unsubscribed.

Once you opt out, you will receive a confirmation message, and we will cease sending the applicable category of messages. Please allow up to 48 hours for opt-out requests to be fully processed.

IMPORTANT:

Opting out of marketing messages will NOT affect transactional messages related to your care (appointment reminders, prescription notifications, etc.) unless you specifically request to opt out of those as well.

6. PRIVACY AND DATA PROTECTION

Your phone number and messaging preferences are protected in accordance with our Privacy Policy and applicable law:

  • We will not sell, rent, or share your mobile phone number with third parties for their marketing purposes.
  • Your phone number will only be used for the purposes described in this Agreement.
  • We implement reasonable security measures to protect your information.

7. WIRELESS CARRIER DISCLAIMER

Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your mobile carrier and may be affected by factors outside our control, including network congestion, device compatibility, and service outages.

8. SUPPORTED CARRIERS

Our SMS program supports most major U.S. wireless carriers, including but not limited to AT&T, Verizon, T-Mobile, Sprint, and their affiliated carriers. If you change your mobile carrier, you may need to re-register to continue receiving messages.

9. CHANGES TO THIS AGREEMENT

We may modify this SMS and Marketing Consent Agreement at any time. If we make material changes, we will notify you by text message or other reasonable means. Your continued receipt of messages after notification of changes constitutes your acceptance of the updated terms.

10. LEGAL COMPLIANCE

This Agreement is designed to comply with the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, the CAN-SPAM Act, and applicable state consumer protection laws. By opting in, you acknowledge that you understand your rights under these laws.

11. ELECTRONIC ACCEPTANCE

BY CHECKING THE OPT-IN BOX(ES) ON OUR WEBSITE AND PROVIDING YOUR MOBILE PHONE NUMBER, YOU ACKNOWLEDGE AND CONFIRM THAT:

  1. You have read and understand this SMS & Marketing Consent Agreement.
  2. You are the owner or authorized user of the mobile phone number provided.
  3. You understand that message and data rates may apply.
  4. You understand that your consent is not a condition of any purchase.
  5. You understand that you can opt out at any time by replying STOP.
  6. You are at least 18 years of age.
  7. Your electronic acceptance constitutes a legally binding agreement equivalent to a handwritten signature.

 

Your consent will be recorded electronically along with the date, time, and IP address of your acceptance.

 

12. WEBSITE CHECKBOX DISCLOSURE LANGUAGE

The following disclosure language appears adjacent to consent checkboxes on our website:

For Transactional Messages Checkbox:

“By checking this box, I consent to receive automated text messages from Nova Lab Clinic regarding my appointments, prescriptions, lab results, and care-related communications at the mobile number provided. Message frequency varies. Message and data rates may apply. Reply STOP to opt out. Reply HELP for help.”

For Marketing Messages Checkbox:

“By checking this box, I consent to receive promotional text messages from Nova Lab Clinic including special offers, health tips, and new service announcements at the mobile number provided. Message frequency varies (up to 4/month). Message and data rates may apply. Reply STOP to opt out. Reply HELP for help. Consent is not a condition of purchase.”

Combined Checkbox Option (if using single checkbox):

“By checking this box and providing my mobile phone number, I consent to receive automated text messages from Nova Lab Clinic regarding my care, appointments, and promotional offers. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time. Reply HELP for help. Consent is not a condition of purchase. View our Privacy Policy and Terms of Service at novalab.clinic.”
